WAIVER, RELEASE, AND ASSUMPTION OF RISK**
Powis Studios LLC
Avaloch Farm Music Institute — Boscawen, New Hampshire

By submitting your registration and deposit, you acknowledge and agree to the terms below. You will be required to sign this waiver in full prior to participating in the Summer School.

1. Acknowledgment of Inherent Risks

I understand that participation in the CGC Summer School (“Event”), hosted by Powis Studios LLC (“Company”), involves activities that may carry inherent risks, including but not limited to:

  • Walking on uneven or rural terrain

  • Use of facilities in a rural environment (including paths, fields, wooded areas, and outdoor spaces)

  • Proximity to a lake or other bodies of water

  • Use of stairs, practice rooms, rehearsal spaces, concert venues, and common areas

  • Weather-related risks

  • The presence of insects, wildlife, and natural hazards

  • Consumption of alcohol (which is permitted at certain times during the Event)

  • Travel to and from the Event

  • Normal physical activities associated with music performance

I understand that these risks may result in injury, illness, property damage, or, in rare cases, death.

I voluntarily assume all such risks, whether known or unknown.

2. Release of Liability

In consideration of being allowed to participate in the Event, I hereby fully release, waive, indemnify, and hold harmless:

Powis Studios LLC, its owners, officers, contractors, employees, agents, instructors, and representatives

from any and all claims, liabilities, demands, damages, costs, or causes of action, arising out of or related to my participation in the Event, including but not limited to claims arising from the negligence of the Company.

This release applies to all injuries, losses, or damages I may experience, including those caused by:

  • Accidents

  • Falls

  • Interactions with the natural environment

  • Alcohol consumption

  • Other participants

  • My own actions

This waiver is intended to be as broad and inclusive as permitted under New Hampshire law.

3. No Liability for Third-Party Facilities (Avaloch Farm)

I acknowledge that the Event takes place at the facilities of Avaloch Farm Music Institute (“AFMI”), which is an independent organization.

I understand and agree that:

  • AFMI has its own separate waiver, which I am required to sign, and

  • This waiver does not limit AFMI’s rights, nor does AFMI’s waiver limit the protections granted to Powis Studios LLC.

I agree that Powis Studios LLC is not responsible for the acts, omissions, conditions, or negligence of AFMI or its staff.

4. Agreement to Sign the Avaloch Farm Waiver

I acknowledge that my participation in the Event is conditional on signing AFMI’s official waiver and participation agreement.

I agree that:

  • I will sign the AFMI waiver when requested

  • I will comply with all AFMI rules, policies, and safety requirements

  • Failure to sign the AFMI waiver will render me ineligible to attend, without refund of deposits or payments already made

5. Medical Responsibility and Fitness to Participate

I certify that:

  • I am physically able to participate in the Event

  • I will disclose any relevant medical conditions if necessary

  • I am responsible for my own medical care and expenses

  • Powis Studios LLC does not provide medical insurance, medical supervision, or emergency services

I authorize Event staff to seek emergency medical attention for me if needed.

6. Alcohol Use Acknowledgment

I understand that:

  • Alcohol may be consumed during designated times at the Event

  • I am responsible for my own choices regarding alcohol consumption

  • Powis Studios LLC is not liable for any injury, harm, or damages resulting from:

    • My consumption of alcohol

    • My behavior while intoxicated

    • Accidents or injuries related to alcohol use

    • My travel or transportation while under the influence

7. Personal Property

I understand that Powis Studios LLC is not responsible for:

  • Lost, stolen, or damaged personal property

  • Instruments, equipment, electronics, or luggage

I bring items at my own risk.

8. Photo, Video, and Audio Release

I hereby grant Powis Studios LLC:

  • Full permission to photograph, video record, and audio record my participation at the Event

  • The right to use such media without restriction and without compensation, including for:

    • Educational materials

    • Marketing

    • Social media

    • Website content

    • Future promotional use

There is no opt-out from media permission as part of this Event.

9. Conduct Expectations

I agree to act respectfully toward staff, other participants, and the facility.

Powis Studios LLC reserves the right to remove any participant whose behavior is unsafe, disruptive, or inappropriate.
Removed participants are not entitled to refunds.

10. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of New Hampshire, where the Event takes place.

11. Binding Effect

This waiver:

  • Applies to me and my heirs, executors, administrators, and assigns

  • Remains in effect for the full duration of my participation in the Event

  • Is intended to be a complete and unconditional release of liability to the fullest extent permitted by law

Acknowledgment

By submitting my deposit and completing the registration process,
I acknowledge that I have read, understood, and voluntarily agree to this Waiver & Release.
I agree to sign this waiver in full prior to my participation in the CGC Summer School.
